The top Republican on the Senate Judiciary Committee has signaled that the GOP will put up a tough fight against Solicitor General Elena Kagan. Alabama Sen Jeff Sessions told Politico Monday that Kagan's activist background could be a significant impediment for GOP support.
The historical record shows that Sessions is being dishonest. The GOP loves activist judges as long as they act in the interest of the GOP. The Republican party cheered when the USSC jumped into the the state of Florida's business to install Bush and Cheney in 2000, they cheered when the same court overturned decades of settled law in the recent Citizens United decision, and they will surely cheer if they are ever able to overturn Roe v Wade.
